Document Description
The project is limited to one encroachment associated with an existing water diversion and
onstream reservoir dam on an unnamed tributary to the West Fork Russian River. A culvert is present on another unnamed
tributary but no work is currently proposed for the culvert. This culvert is not covered under this Agreement. Water storage is
covered under Appropriative Water Right No. A026201 with a face value of 2 acre-feet to be collected October 1 of one year
through April 15 of the following year. No water will be diverted for consumptive use from the existing POD except for
emergency fire suppression and for domestic use and for irrigation of commercial cannabis and vineyard. This Agreement does
not cover water diverted for use for any purposes other than to storage in the existing onstream reservoir. This Agreement
does not retroactively permit any crossings, diversion, or other encroachments including the existing culvert.
