The project is limited to one encroachment associated with an existing water diversion from Davis Creek (offset well). No water will be diverted for consumptive use from the existing POD except for Cannabis irrigation and for emergency fire suppression under this Agreement. This Agreement does not cover water diverted for use for any purposes other than to storage in storage for use during the low-flow periods. This Agreement does not retroactively permit any crossings, diversion, or other encroachments not described in the Notification.
