The governor declared a State of Emergency on October 30, 2015 and articulated the need to protect life and property by removing dead and dying trees from the vicinity of roads, communities, powerlines, and other critical infrastructure. Statutory Exemption Section 15269© Emergency Project pertains to specific actions necessary to prevent or mitigate an emergency, Class 1 (h) project consists of the operation, repair, maintenance or minor alteration of existing public facilities involving negligible or no expansion of use and a Class 8 project consists of actions taken by regulatory agencies, as authorized by state or local ordinance, to assure the maintenance, restoration, enhancement or protection of the environment where the regulatory process involves procedures for protection of the environment
