Document Description
Pursuant to Public Resources Code Section 25402.1(h)(2) and Section 10-106 of Title 24 of the California Code of Regulations, the City of Davis has applied to the Energy Commission for a determination that is locally adopted energy efficiency standard, enacted in Local Ordinance No. 2426, will require buildings to be designed to consume no more energy than permitted by the Building Energy Efficiency Standards adopted by the Energy Commission. The Energy Commissions' Building Standards are set forth in Title 24, Part 6 of the California Code of Regulations. The Ordinance requires certain buildings to comply with Tier 1 requirements in the California Green Building Code, codified in title 24, part 11, which are adopted by the Energy Commission and establish voluntary standards that exceed the Building Efficiency Standards. The Energy Commission found that the City of Davis's ordinance will require the diminution of energy consumption levels permitted by the 2013 Building energy efficiency standards.

Reasons for Exemption
The California Energy Commission determined that the activity is covered by the general rule that California Environmental Quality Act (CEQA) applies only to projects which have the potential for causing a significant effect on the environment. It can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, therefore the activity is not subject to CEQA.
