Document Description
The Antelope Valley-East Kern Water Agency ("AVEK"), an independent special district of the State of California, has approved a Water Purchase and Common Land Owner Transfer Agreement, with WDS California II ("WDS"), a California corporation. AVEK has executed a Water Supply Contract with the State of California Department of Water Resources ("DWR") for the purchase of water from the State Water Project ("Imported Water") for use within AVEK's boundaries. Under the Agreement, AVEK will transfer up to 5,000 acre-feet of Imported Water to WDS, conditioned upon the approval of DWR and the Kern County Water Agency. AVEK will transfer the imported water to WDS in calendar year 2016, but instead of using the Imported Water on WDS property located within AVEK's boundaries, WDS will use the Imported Water on property also owned by WDS within the boundaries of the Kern County Water Agency for agricultural purposes.

This water transfer is exempt from CEQA pursuant to a Class 1 categorical exemption. The proposed water transfer qualifies for the Class 1 exemption because it involves the use of existing publicly owned water facilities within the boundaries of AVEK and the Kern County Water Agency. (§15301(b).) The water transfer will occur within the existing facilities of the California Aqueduct and involves imported water that otherwise would be consumed or stored by AVEK. The Imported Water will be transferred from the service area of AVEK to the service area of the Kern County Water Agency, for the use by WDS. This water transfer does not involve any change or expansion of an existing use. The transfer will not change quantity of water delivered through the California Aqueduct. Therefore, the proposed transfer would be exempt pursuant to a Class 1 exemption.
