Notice of Exemption

Exempt Status
Statutory Exemption
Type, Section or Code
S:15275(a)(b) 21080(b)(11)(12)
Reasons for Exemption
The State CEQA Guidelines provide a series of Statutory Exemptions for actions that have been deemed by the State Legislature to be exempt from requirements of the California Environmental Quality act (CEQA). The proposed installation of an approximate 2.4 mile lead rail track to the proposed City of Placentia Metrolink Station has been determined to qualify for a Statutory Exemption under paragraph 21080(b)(11)(12) CEQA the statute and the State CEQA Guidelines, Section 15275(a)(B). Installation of this new lead track will provide sufficient protection for passenger trains to access the proposed Placentia Metrolink Station without conflict with the BNSF main line freight operations. The proposed installation and future utilization of this lead track as part of the Metrolink Passenger Rail system have been determined to not fall under the jurisdiction of CEQA and the State CEQA Guidelines because this improvement will support mass transit passenger train operations conducted by Metrolink and it will convey/transfer passengers from this mass transit guideway to the proposed Placentia Metrolink Station. Therefore, this action qualifies with the requirements for a Statutory Exemption, under Paragraph 20180(b)(11)(12) of the CEQA Statute.
