No project is being submitted by a private party, and thus there is no applicant. In enacting the ordinance sections 4.201.3, 4, 5 and 5.201.3,4 the City of Santa Monica establishes and mandates the installation of a minimum amount of solar PV for new residential and nonresidential buildings. Sections 4.201.3,4,5 ensure that new buildings will exceed the current State energy standards by requiring the use of solar PV.

Reasons for Exemption
As the responsible agency, the California Energy Commission determined that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. (Sec. 15061(b)(3).) Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Here, a negative declaration was previously adopted for the State Standards as a whole. See SCH No. 2012032062. These standards are more protective of the environment than the State Standards, and there are no reasonably foreseeable adverse impacts, and so there is no possibility that the activity in question may have a significant effect on the environment. As the lead agency, the City of Santa Monica also determined that this activity is exempt from CEQA under section 15061(b)(3).
