Reasons for Exemption
Cal. Code Regs., tit. 14, sec. 15301 provides that projects which consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, and which involve negligible or no expansion of use beyond that existing at the time of the lead agency's determination, are categorically exempt from the provisions of the California Environmental Quality Act (CEQA). This project involves installation of one new high volume compressed natural gas (CNG) refueling station at an existing facility and will be used only to refuel CNG refueling trailers. The existing facility contains parking and fueling equipment for Kern County Superintendent of School's existing CNG fueling infrastructure. The additional station proposed in this project will aid the KCSOS's goal of providing CNG to public and private customers. There will be a negligible expansion of use due to it fueling only trailers. Therefore, the project falls within section 15301 and will not have a significant effect on the environment.
Cal. Code Regs., tit. 14, sec. 15306 provides that projects which consistent of basic data collection, research, experimental management, and resource evaluation activities which do not result in a serious of major disturbance to an environmental resource are categorically exempt from the provisions of CEQA. This project consists of installation of a small piece of new equipment to supplement existing compressors and allow for the planned refueling of KCSOS's CNG refueling trailer. Specifically, the equipment to be installed is approximately the size of a telephone booth. Therefore, the project falls within section 15306 and will not have a significant effect on the environment.
