Reasons for Exemption
The project is exempt pursuant to Section 15304 of the California Environmental Quality Act (Minor alterations to Land). Section 15304 discusses fuel management activities within proximity to structures to reduce flammable vegetation, provided that the activities will not result in taking of endangered, rare, or threatened plant or animal species or significant erosion and sedimentation of surface waters. This exemption is extended to 100 feet of clearance in areas of fire hazard. As indicated in the preamble to section 15304, examples are provided as guidance and similar activities that meet the intent of the section may also be exempt. The Planning Department finds that fuel management activities within County rights of way are essential to maintain the public right-of-way and reducing fire hazards within the County and consistent to section 15304 of CEQA.
