Ordinance for Zone Change RZ15-008 to rezone 0.4± of O (Open Space) to RE-5 (Residential Estate, Five Acre Minimum) and rezone 0.4± of RE-5 to O (Open Space) on a 5.8± acre parcel currently zoned RE-5 and O (Open Space) under Title 17 of the Tuolumne County Ordinance Code.
After reviewing the project and its setting, the Environmental Coordinator for the County of Tuolumne has determined that the project is categorically exempt from review under the California Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3) of the State CEQA Guidelines because the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The Zone change would relocate 0.4± acre of O (Open Space) zoning on the site to an area that supports better wildlife habitat. Therefore, there is no possibility that the project would have a significant effect on the environment.
