NOE - Notice of Exemption
The applicant requests approval for a Variance to allow for a reduction in the front setback requirement from the road and utility easement which traverses the south side of their property. The required setback from the easement is 75 feet from center line of the traveled way, or 50 feet from the edge of easement, whichever is greater. The applicants are requesting to be allowed a 19-foot setback from the centerline of the traveled way (12 feet from the edge of easement) for the installation of a perimeter six-foot safety fence around an in-ground swimming pool, with the construction of the pool's edge no closer than 25 feet from the center of traveled way (18 feet from the edge of easement).
