Document Description
The proposed project is Amendment No. 3 to the lease with Anthony's Fish Grotto of La Mesa (Anthony's) for property located at 1360 North Harbor Drive in San Diego, CA. Anthony's currently has a lease with the District that consists of a 1,080 sq. ft. water easement for a subsurface waterline and a 31,608 sq. ft. building divided into the following three existing operations: (1) a 75-seat quick-serve restaurant; (2) a 336-seat full service restaurant; and (3) a 106 seat banquet and conference room. Anthony's has operated under this lease since 1965, which includes outdated lease language dating back to the commencement of the lease. The lease is set to expire on Jan 31. 2016, triggering end of term requirements which are not consistent with current District practices. In addition to its lease with the District, Anthony's has three separate Tideland Use and Occupancy Permits (TUOPs) with the District associated with the operation of its leasehold which includes 72 sq. ft. of area used for advertising signage, 162 sq. ft. of area used for a canopy and additional signage, and 500 sq. ft. of area used for a quick-serve restaurant. The proposed lease amendment incorporates the current existing lease areas, the three areas covered under Anthony's existing TUOPs, clarifies end of term requirements, and updates the lease language to the District's current standard lease language, including hold harmless and sustainable leasing language. The proposed lease amendment will allow the District to streamline management of the leasehold for the remaining two years of the lease and align end of term requirements to current District practices.
