Reasons for Exemption
a. The Variance project is part of the Harvest Subdivision, which is part of the WRSP Project FEIR (SCH #2015022030) that was approved by the City Council on September 21, 2021, under Resolution 2021-75. There is no substantial evidence of changed circumstances under CEQA Guidelines Section 15162. b. Class 5, Section 15305, provides an exemption for projects consisting of minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use density, including minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel. This project does has an average slope of less than 20%, does not change land use density, and does not create a new parcel.
