Phase II of an ongoing effort to develop a Medical Marijuana Land Use Ordinance. The current phase (Phase II) of the Ordinance works to control nuisance impacts within neighborhoods through the regulation and restriction of the outdoor cultivation of medical marijuana for personal use on parcels that are five acres of smaller in size. It also establishes an expedited abatement process for addressing violations of the Ordinance.
The Ordinance is not a project as defined in section 15378, and will not result in a direct/indirect physical change to the environment. If considered a project the ordinance still may be found exempt as it can be seen with certainty that it would result in a significant effect on the environment. Additionally, the Ordinance qualifies for use of the cited categorical exemptions as it includes provisions for specialized enforcement pursuant to established nuisance criteria, and will assure greater protection of the environment than continuance under the status quo / baseline regulatory condition.
