Document Description
Project involves approval of the Corrective Measures Proposal by the Department of Toxic Substances Control (DTSC) pursuant to the requirements of Health & Safety Code Chapter 6.5 section 25187 and 25200.14. The California Code of Regulations, title 22, division 4.5, chapter 39, section 67391.1 clarifies DTSC's authority to require land use restrictions in the form of covenants, and the exceptions for properties that have contamination left in place. The regulations require DTSC to set forth and define land use restrictions in a remedy selection document, such as the Corrective Measures Proposal, when contamination is left in place. The purpose of the covenant is to protect public health and safety, and the environment from contaminated land when contamination will remain at the property at levels which are not suitable for unrestricted use of the land.
The activity involves administrative preparation and development of a Land Use Covenant (LUC) document to restrict the property to industrial use only. The LUC will be recorded in the County of San Diego. The LUC will specify certain activities that will not be allowed at the site such as no drilling, and disturbance of the concrete floor, and the facility cannot be used for residence, hospital or day care center. The epoxy coating on the exterior block wall will also be maintained.

Project will not require the relocation of residence or businesses.
Project will not involve the potential release into the air or volatile organic compounds as defined in Health & Safety Code section 25123.6.
