Reasons for Exemption
The Project categorically exempt from the CEQA pursuant to Title 14 of the California Code of Regulations, (State CEQA Guidelines) 15315, (Minor Land Divisions). The Section 15315 (Minor Lands Divisions) exemption applies to projects consisting of the "division of property in urbanized areas zoned for residential use into four or fewer parcels when the division is in conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the proposed parcels to local standards are available, the parcel was not involved in a division of a larger parcel within the previous two years, and the parcel does not have an average slope greater than 20 percent." Proposed project is consistent with the General Plan. Project will be served by private well and septic services. The provision of private septic service is consistent with the General Plan (Policy PF-10). The project is served by all other necessary services. The site is directly accessible from Brahma Lane, a public street, and access to the parcel 2 is provided from an existing easement consistent with City policy and standards. The parcel was not involved in a division of a larger parcel within the previous 2 years. The project site is flat and does not have a slope greater than 20 percent. No other special circumstances exist that would create a reasonable possibility that the proposed Project will have a significant adverse effect on the environment. Therefore, the proposed Project qualifies for the exemption under CEQA Guidelines Section 15315 and no further environmental review is required.
