- Issuance of a Streambed Alteration Agreement No. 1600-2013-0404-03 is pursuant to Fish and Game Code Section 1602. At each repair site, the total area of disturbance will be 4,000 square feet including the pipeline excavation area, the adjacent side-cast area, and staging area. Access to the repair sites will be via existing roads and overland access to a few of the repair sites. For those repair sites that do not require overland access, the repair sites are located immediately adjacent to the existing road. The repair site footprints and overland access routes will be staked and fenced with silt fencing backed by orange construction fencing prior to the commencement of the repairs. All construction equipment will be limited to the existing roads and the area within the fence lines.

- CDFW determined in that capacity that the Project and issuance of this ITP constitutes a Statutory Exemption as defined by CEQA. (ld., §21080.23; Cal. Code Regs., tit 14, § 15284). Issuance of the ITP, in this respect, is statutorily exempt from further environmental review under CEQA because under Cal. Code Regs., tit 14, § 15284 CEQA does not apply to any project consisting of the inspection, maintenance, repair, restoration, reconditioning, relocation, replacement, or removal of an existing hazardous or volatile liquid pipeline or any valve, flange, meter or other piece of equipment that is directly attached to the pipeline if the pipeline diameter will not be increased and the Project is not located within the boundaries of an oil refinery.
