Document Description
DTSC is proposing to approve an Amendment to Response Plan (Amendment) to augment the Response Plan (Original Response plan) dated 12 July 2013, which was approved by DTSC on 15 July 2013. A MND and an IS, dated 5 May 2013 were prepared by the City of Sunnyvale to address potential environmental impacts from the originally planned cleanup and the planned development project. DTSC relied on the City's MND/IS and prepared a NOD dated 15 July 2013, to comply with CEQA. DTSC is overseeing cleanup at the Site under an agreement pursuant to the CA Land Reuse and Revitalization Act of 2004, CA Health and Safety Code Section 25395.60 et seq. ("CLRRA"), with 470 Investors. KB bought the Site from Persian Drive Investors, LLC and, pursuant to the Assignment and Assumption Agreement dated 30 October 2013, assumed responsibility for implementing the Original Response Plan. However, as a result of additional data collected during the confirmation sampling phase of the Original Response Plan and additional planning by KB, it was concluded that certain changes were required to the Original Response Plan to address remediation on Site.
