The facility consists of a single story building containing approximately 21,000 rentable square feet. ARFCD's current lease is scheduled to terminate on June 30, 2014.

Reasons for Exemption
The Project is categorically exempt under 14 Cal. Regs. section 15301 of the CEQA Guidelines because it involves operation and maintenance of existing facilities (only changing ownership) to be operated within existing limits established by applicable laws, regulations, agreements, and permits. Continued use of the existing facilities following the change in ownership also would involve, at most, replacement/reconstruction of an existing structure, and therefore is exempt under 14 Cal. Code Regs. section 15302. The project also is an "in-fill development project" categorically exempt under 14 Cal. Code Regs. section 15332. ARFCD has determined that the facility is fully consistent with all applicable general plan requirements and zoning. The facility occupies fewer than five acres and is substantially surrounded by urban uses. 185 Commerce Circle has no value as habitat for endangered, rare or threatened species. Because ARFCD does not intend to substantially change the footprint of the existing facility, approval of the purchase would not result in any significant effects related to traffic, noise, air quality, or water quality. Finally, the site is served and will continue to be served by all required utilities and public services.
