The Butte County Recycled Water (Wastewater) Pond Ordinance (the proposed Ordinance, included as Appendix A to this IS) would codify a process for the siting, design, construction, use, maintenance, and regulation of recycled wastewater ponds for the holding and dispersing of recycled waters as defined in Section 198-2(E) of the Ordinance and (consistent with Title 22 CCR, Division 4 Env. Health, Ch. 3 - Water Recycling Criteria). Subject to the topographic, soils, design, setback, floodplain, and minimum flow/capacity limitations specified in the proposed Ordinance, a recycled wastewater pond could be built anywhere in the unincorporated County outside of municipal and sanitary district spheres of influence. A recycled wastewater pond would require approval of a use permit, WDRs, and other permits.
