Notice of Exemption

Exempt Status
Emergency Project
Type, Section or Code
21080(b)(4); 15269(b(c)
Reasons for Exemption
A failure of the CAAQ levee would disrupt the distribution of municipal and agricultural water south of the breach, which is necessary to maintain service essential to public health, safety, and welfare. Additionally, a catastrophic failure of the levee would cause severe flooding of the surrounding area, which is owned and occupied by private landowners, and impact the Delta Mendota Canal.
