Statutory Exemption

Reasons for Exemption
The culvert outlet failure includes a joint separation of the outlet, the displacement of the attached headwall, and damage to the attached tide gate. This has allowed tide waters to flow above and around the headwall, eroding the roadway prism. There is a high potential for the roadway shoulder to collapse due to this erosion. Emergency repairs are necessary to protect public safety, essential services, and public and private lands.
