Document Description
AB 531 and AB 1103, codified at Public Resources Code, section 25402.10, requrie the Energy Commission to regulate the benchmarking of nonresidential buildings and the disclosure of the resulting data to prospective buyers, lessees, and lenders. The regulations adopted today by the Energy Commission set a schedule for compliance, as well as makde specific the requriements of the statute for owners to benchmark their building's energy use within the U.S. EPA's Energy Star Portifolio Manager program and to make the disclosures.

Reasons for Exemption
The action taken to comply with regulations chiefly consist of measuring the energy use of nonresidential buildings on a U.S. EPA website and the presentation of disclosure materials that show the building's energy use. The regulations do not constitute a project under CEQA's "common sense" exemption because they will not cause a significant effect on the environment. By increasing awareness of energy use and providing incentives to make nonresidential buildings more energy efficient, the regulations will have a beneficial effect on the environment.
