Document Description
This project proposal is to adopt a focused revision to the 2009 Housing Element of the City of Folsom General Plan. Specifically, the proposal is to revise Program 191 (Inclusionary Housing) of the 2009 Housing Element which will require the City to amend the Inclusionary Housing Ordinance (IHO) by adjusting the affordable percentage requirements and establishing an in-lieu fee option. In addition, this project proposal is to implement the aforementioned 2009 Housing Element Revision by amending Chapter 17.104 of the Folsom Municipal Code (FMC) to adjust percentage requirements and establish an in-lieu fee option. Also, this project proposal includes removing existing provisions of the IHO pertaining to multi-family rental housing projects as a result the 2009 court case, Palmer/Sixth Street Properties, L.P. vs. City of Los Angeles 175 Cal. App 4th 1396 (2009).
