Under Public Resources Code Sections 48700-48706, manufacturers of architectural paint sold in CA must develop a plan (the CA Architectural Paint Stewardship Program Plan) by which they will implement a program to collect, transport, and process postconsumer paint to reduce the costs and environmental impacts of the disposal of postconsumer paint in the state. In this case, architectural paint manufacturers, working collectively through a stewardship organization called PaintCare, prepared a statewide stewardship plan. The Department of Resources Recycling and Recovery has authority to approve the plan, provided it meets the statutory requirements. The Department's approval of the statewide CA Architectural Paint Stewardship Program Plan is the project that the Department has evaluated pursuant to CEQA.
