Document Description
On December 15, 2011, the California Fish and Game Commission (Commission) adopted section 749.7 of Title 14 of the California Code of Regulations as an emergency regulation under the Administrative Procedure Act (APA). The regulation as adopted by the Commission pursuant to Fish and Game Code section 2084 authorizes incidental take of the Black-backed woodpecker subject to certain terms and conditions prescribed in the regulation during the species' status as a candidate for listing under the California Endangered Species Act (CESA) (Fish & G. Code Section 2050 etseq.).
