Document Description
The Clean Trucks Program (CTP) in POLB was originally administered by the Drayage Truck Concession Agreement, which was put into place in July, 2008. The CA was challenged in court by the American Trucking Association on the grounds that it was preempted by federal law. Pursuant to the Settlement Agreement, POLB agreed that the CA would be replaced by a Registration Agreement as POLB's mechanism for implementing the CTP, that execution of the RA would supercede any individual CA a motor carrier may have executed, and that the POLB would not enforce any term of the CA against any motor carrier upon execution of the RA. POLB has prepared a Neg Dec and supporting Initial Study in order to present an analysis of any potential environmental effects of the settlement of the ATA litigation. http://www.polb.com/ceqa.
