Document Description
Mr. Charles Sawyer filed a petition for change for License 5118 with the Division of Water Rights on August 19, 2010. The petitioner proposes adding storage and frost protection as a purpose of use under the license. License 5118 authorizes direct diversion of 88 acre-feet per annum from the main stem Russian River for irrigation of 45 acres of vineyard. Diversion is allowed from May 1 to October 15. The Petitioner recently built 7.8 acre-foot offstream storage reservoir. The Petitioner seeks the ability seeks the ability to use storage water for frost protection in the months of May or June, and irrigation in the late summer months. By adding frost protection and storage under the license, the Petitioner believes he will be able to relieve the instantaneous draw down on the main stem during frost events. The season of diversion will remain the same. The amount of water diverted annually will not change. The point of diversion and the place of use are existing and will not be changed. The maximum instantaneous rate of diversion from the river will be lower than was previously authorized, and therefore, will help minimize the chances of dewatering of the river channel and associated cumulative impacts to the environment.

Approval of the petition for change will not result in any physical changes to the environment relative of the California Environmental Quality Act baseline conditions because all project features associated with the petition existed in their current configuration prior to the date the Division began its environmental review under CEQA. Thus, the petition for change is categorically exempt under CEQA in accordance with Title 14, California Code of Regulation, section 15301.
