Document Description
IS-1 (Construction Mitigation Rule) is a proposed control measure which the District committed in the 2009 Sacramento Regional 8-Hour Ozone and Reasonable Further Progress Plan (Plan). The control measure would have required mitigation of NOX emission on new land use construction sites by using cleaner equipment or paying a fee for the District to mitigate the emissions. The District removes the proposed control measure from the Plan because of the following factors; (1) The mitigation rule largely duplicate our existing CEQA construction mitigation program that is being more consisting implemented by CEQA lead agencies; (2) Construction emissions are significantly lower than previously estimated, in part, because of the recent economic downturn; and (3) The mitigation rule adds administrative costs and new or increased fees that may be subject to Proposition 26.

The removal of IS-1 does not require substantial changes to the Plan which require major revision to the previous EIR and, therefore, the proposed revision to the Plan is exempt from CEQA pursuant to California Code of Regulations Title 14, Chapter 3, Section 15162(a)(1)- Subsequent EIRs and Negative Declarations.
