Document Description
On July 11, 2011, the California Department of Fish and Game, one of several entities responsible for preparing the Drought Plan, reached consensus on the Drought Plan that it should be forwarded for review under Section 19.2.3.E. of the Klamath Basin Restoration Agreement (KBRA). The Drought Plan established a process for responding to Drought or Extreme Drought. (Collectively "Drought Conditions") as those terms are presented in the Drought Plan. When Drought Conditions occur, the parties to the Drought Plan intend for water and resource management actions to be taken such that no Klamath Basin interest would bear an unreasonable portion of burdens imposed or the risk of loss or injury.

This notice documents DPG's determination that forwarding the Drought Plan for review under Section 19.2.3.E. of the KBRA does not require prior compliance with the California Environmental Quality Act (CEQA) because the Drought Plan is not a project under CEQA. The Drought Plan does not identify any specific actions that would be required to be implemented in response to Drought Conditions. Instead, the Drought Plan merely identifies three general categories comprise any number of potential, specific actions that could be implemented without mandating any. As a result, the Drought Plan lacks meaningful information to conduct CEQA review and it is unclear if adoption of the Drought Plan would cause a change in the physical environment.
