Document Description
Department of Toxic Substances Control (DTSC) has issued an emergency permit to Clean Harbors San Jose, LLC (Clean Harbors) to store hazardous waste beyond the ten days provided in Title 22, California Code of Regulations Section 66263.18. The hazardous waste to be stored is two 55-gallon drums of iron aluminum and iron alloy shavings and powders in an aqueous lubricant/coolant which became reactive. Although the aqueous mixture was drained and replaced with mineral oil and the drums were overpacked in 85-gallon drums, the contents of the drums continued to be under pressure. The drum cannot be transported and must be stored until the reaction is stopped and the drums are stabilized. As the ten days during which Clean Harbors may store a hazardous waste will expire before the drums can be transported, the Department of Toxic Substances Control (DTSC) has determined that an emergency permit should be issued. The permit is effective from June 30, 2011 to July 6, 2011.
