Document Description
On June 15, 2011, the Zoning Administrator approved the following: an amendment to a previously approved modification permit that allowed the installation of a second freestanding sign (where the zoning code limits the property to one) for project and tenant identification for Westcliff Plaza. The June 15, 2011 approval included replacement of two existing pylon signs and allows a maximum height of 20', a width of 7' 2", and a sign copy area of 97.5 sq. ft. to allow the addition of tenant name identification. The increase sign size in necessary due to the lack of direct street frontage views, thereby improving the readability of the tenant listing from the street frontage. Also on June 15, 2011, the Zoning administrator determined that the project is exempt from further environmental review consistent with the California Environmental Quality Act (CEQA) Guidelines under section 15311, Class 11 (Accessory Structures) that exempt small accessory structures such as on-premise signs in commercial area. Reasons for Exemption
The City considered any potential environmental effects of the proposed project. Based on the Zoning Administrator review and all supporting materials provided, the Zoning Administrator determined that the project is exempt from further environmental review consistent with the Class 11 - Accessory Structures exemption under CEQA Guidelines section 15311. Class 11 consists of construction or replacement of minor structures accessory to (appurtenant to) existing commercial, industrial or institutional facilities including on-premise signs. The signs are accessory to the primary use of the site which is designated as Neighborhood Commercial (NC) in the Land Use Element of the City's General Plan. The addition of signs and the modification of sign size, lettering and illumination are consistent with Class 11 construction and replacement of minor structures. The increase in the number and size of the signs will, therefore, have no significant environmental impact. The Zoning Administrator found the following to determine that the project is exempt from further CEQA review. 1. The modification permit is consistent with the legislative intent of Title 20, Chapter 20.52 of the Newport Beach Municipal Code with regard to modification permit regulations. 2. The granting of the permit will not adversely affect the health of safety of persons residing or working in the neighborhood of the property and will not be detrimental to the general welfare or injurious to property of improvements in the neighborhood.
