On June 11, 2014, the California Regional Water Quality Control Board, San Francisco Bay Region (San Francisco Bay Water Board) adopted Resolution No. R2-2014-0028, amending the Water Quality Control Plan for the San Francisco Bay Region (Basin Plan). The Basin Plan amendment (OWTS amendment) incorporates, as required by State law (Water Code section 13291(e)), the State Water Resources Control Board's (State Water Board's) Onsite Wastewater Treatment System Policy (approved by the Office of Administrative Law on November 13, 2012). The OWTS amendment also amends the Basin Plan's wet weather overflow section to conform to existing law and makes other editorial, non-regulatory changes to the Basin Plan. The OWTS Basin Plan amendment was approved by the State Water Board under Resolution No. 2014-0064 on November 18, 2014, and by the Office of Administrative Law on February 17, 2015. A Substitute Environmental Document (SED) was prepared by the State Water Board for the Water Quality Control Policy for Siting, Design, Operation, and Maintenance of Onsite Wastewater Treatment Systems (OWTS Policy) in accordance with the State Water Board's certified regulatory program (Cal. Code Reg., tit. 23 Sec. 3777-3781). The State Water Board approved the OWTS Policy and the SED under resolution No. 2012-0032 on June 19, 2012. The proposed amendment harmonizes existing Basin Plan provisions concerning onsite wastewater treatment systems with the State Water Board's OWTS Policy and incorporates that policy by reference. No substantive changes or modifications to the previously approved OWTS Policy are proposed. No substantial changes with respect to circumstances under which the project will be undertaken have occurred, and no new information triggers the need for supplemental or subsequent CEQA analysis.
