Document Description
The Water Purchase and Sale Agreement for the Cadiz Valley Water Conservation, Recovery and Storage Project and the Groundwater Management Monitoring and Mitigation Program (GMMMP) were approved by the Santa Margarita Water District (District) on July 31, 2012 in reliance upon a certified Environmental Impact Report (EIR). The Water Purchase and Sale Agreement authorized the District to consider formation of the Fenner Valley Water Authority (FVWA), which would control all of the capital facilities for the Project under a facilities lease from Cadiz, Inc. and to contract with the Fenner Valley Mutual Water Company controls the right to take water from the basin under the water lease with Cadiz and that water is then provided to the Mutual members via the facilities under which it is being undertaken or present any new information requiring revisions to the EIR. Thus, pursuant to Public Resources Code section 21166 and State CEQA Guidelines section 15162, no further environmental review is required for approval of the JPA.
