Transfer of a total of 112,114 sq. ft. of general office intensity from Block 100. 75,878 sq. ft. will be transferred to San Joaquin Plaza and 45,236 sq. ft. will be transferred to Block 600. 430 residential units will be re-assigned from San Joaquin Plaza to Block 500. The transfer will occur in accordance with the Transfer of Development Rights provision in the North Newport Center Planned Community Development Plan Section IV (C).

The Transfer of Development Rights from Block 100 to Block 600 and San Joaquin Plaza is considered a ministerial action because it only involves application of fixed standards. As a Ministerial action, the Transfer of Development Right is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA S 21080(b)(1) and CEQA Guidelines S 15268. As detailed in CEQA Guidelines S 15369, "Ministerial' describes a governmental decision involving little or no personal judgment by the public official as the wisdom or manner of carrying out the project. The public official merely applies the law to the facts as presented but uses no special discretion or judgment in reaching a decision."
