Document Description
Kern Delta will deliver up to 30,000 acre feet of SWP water to Rosedale for banking in the name of Kern Delta on or before December 31, 2010. The amount of water offered to Rosedale by Kern Delta shall be within the sole discretion and judgment of Kern Delta. The amount of water accepted by Rosedale for banking in the name of Kern Delta shall be within the sole discretion and judgment of Rosedale. Rosedale shall not accept water from Kern Delta if doing so would require Rosedale to physically occupy and utilize more basin storage capacity than the maximum amount considered in connection with its CEQA review of previously approved projects, i.e., the activity will only use surplus capacity in projects for which CEQA review has been completed. No new facilities will be built as a part of the program. Transportation, delivery, recharge, banking, storage, recovery and return of water will be accomplished, if at all, using the surplus capacity, if any, in existing facilities owned or operated by either party.
