Reasons for Exemption
The State CEQA Guidelines provide a series of Statutory Exemptions for actions that have been deemed by the State Legislature not to be subject to the California Environmental Quality Act (CEQA), i.e, not a project under the Statute. The proposed action is the installation of approximately 2,640 lineal feet of 8" water pipeline along existing paved roadways within the City of Highland by the East Valley Water District that would deliver adequate water supply and fire flow to the project area. Statutory Exemption 15282 states: (k) This division does not apply to any project of less than one mile in length within public street or highway or any other public right-of-way for the installation of a new pipeline. The proposed action has been determined to fall within the scope of Statutory Exemption 15282. Therefore, this project action is not a "project" subject to CEQA or the State CEQA Guidelines.
