Document Description
On September 15, 2010, the California Fish and Game Commission (Commission) adopted section 749.6 of Title 14 of the California Code of Regulations as an emergency regulation under the Administrative Procedure Act (APA). The regulation as adopted by the Commission pursuant to Fish and Game Code section 2084 authorizes incidental take of Mountain yellow-legged frog subject to certain terms and conditions prescribed in the regulation during the species' status as a candidate for listing under the California Endangered Species Act (CESA) (Fish & G. Code, Sec. 2050 et seq.). The Commission adopted the emergency regulation based on a finding that the regulation is necessary for the immediate preservation of the general welfare, among other reasons.
