- The project involves relocation of 3 small school programs operated by the Sacramento City Unified School District to an existing available school facility known as the Genesis site, located at 5601 47th Avenue. The project would transfer students from the following three school programs: American Legion High School, the Fern Bacon Accelerated Program (grades 9-12), and the Success Academy (grades 4-8). In total this would transfer approximately 442 students to the Genesis site. The Genesis site is currently vacant and has a working capacity of 720 students. No physical improvements are required to accommodate the transfer of students.

- Section 21080.18 of the CEQA Statutes states that CEQA "does not apply to the closing of any public school in which kindergarten or any of grades 1 through 12 is maintained or the transfer of students from that public school to another school if the only physical changes involved are categorically exempt under Chapter 3 (commencing with Section 15000) of Division 6 of Title 14 of the California Administrative Code." The project is the re-assignment and transfer of students to an existing available school site with available capacity. No physical changes are required to accommodate the students and the proposed transfer of students would result in an enrollment which would not approach or exceed the design capacity of the new site.
