Document Description
The 2-Gates Project proposes to install and operate temporary "butterfly gates" in Old River and Connection Slough. The Gates will be installed on steel barges ballasted into place on prepared beds in the channel reinforces with rock and connected to adjoining levees by sheet pile walls. The gate design consists of double gates supported on a center pivot to allow vessels to pass through when the gates are open. Each gate would feature boat ramps for portage of small boats during gate-closed conditions and levees on either side of the gates would be bolstered using sheet piles and rock. The gates will be operated to influence hydrodynamic and water quality conditions to reduce entrainment of delta smelt by the Central Valley Project (CVP) and State Water Project (SWP) facilities during 2 critical life stages: pre-spawning adult and larval or juvenile development.

Reasons for Exemption
The Project is a Declared Emergency Project subject to the Governor's Proclamation of a State of Emergency of February 2, 2009 (attached). The 2-Gates Project is an exempt emergency project under the statute because it is a "specific action necessary to prevent or mitigate an emergency." The Emergency Drought Proclamation established that a drought emergency in fact exists. The Governor's findings in the Proclamation attached to this document itself support the emergency determination. The Secretary for the California Natural Resources Agency and the Secretary for the California Environmental Protection Agency have concurred that using the above CEQA exemptions for the this Project is consistent with the Proclamation.
