Document Description
On November 10, 2009, the City Council of the City of Newport Beach ("City Council") adopted by ordinance the amendment of: (1) Planned Communtiy No. PA2007-151 to include the portions of Newport Center Clocks 100, 400, and 800 and the open space parcel in the northern portion of Newport Village, all owned by the Irvine Company; (2) the Block 400, Block 800, and Newport Village Planned Community Development Plans to no longer include the property being incorporated into the amended North Newport Center Planned Community Development Plan ("Development Plan"); and (3) Districting Map Nos. 48, 49, and 50 to reflect these changes (collectively, "Amendments"). Also on November 10, 2009, the City Council determined by resolution that the Amendments are exempt from further environmental review consistent with the "common sense" exemption under California Environmental Quality Act ("CEQA") Guidelines section 15061 (b)(3) (Cal. Code Regs. tit. 14, 15061(b)(3)

Reasons for Exemption
The City analyzed any potential environmental effects of the Amendments. Based on the City Council Staff Report, all supporting materials provided, and the full administrative record, the City Council determined that the Amendments are exempt from further environmental review consistent with the "common sense" exemption under CEQA Guidelines section 15061(b)(3). The City council found the following to determine that the Amendments are exempt from further CEQA review; 1. The amended Development Plan is consistent with the City of Newport Beach General Plan and Municipal Code section 20.35.050(c), which establishes the requirements of a Planned Community Development Plan. 2. The amended Development Plan will not increase the intensity of density of allowable land usees or change the types of allowable uses in the portions of Blocks 100, 400, and 800 or the open space parcel in the northern portion of Newport Village, all owned by the Irvine Company; in the areas already covered by the Development Plan; or on any other properties. 3. The portions of Blocks 100, 400, and 800 owned by the Irvine Company are fully developed, the open space parcel in the northern portion of Newport Village owned by the Irvine Company shall remain designated as open space, and the Irvine Company does not seek any further entitlements through the Amendments. 4. It can be seen with certainty that there is no possibility that the Amendments will result in any environemntal impacts because the amended Development Plan simply extends the existing zoning restrictions to include the portions of Bloack 100, 400, and 800 and the open space parcel in the northern portion of Newport Village, all owned by the Irvine Company. Thus, the Amendments are exempt from further environmental review consistent with the common sense exemption under CEQA Guidelines section 15061(b)(3)
