Document Description
The SLDMWA proposes to enter into a one-year transfer agreement with the TCCA to acquire a combined total of up to 30,000 acre feet of water. The water will be made available through groundwater substitution and voluntary crop shifting actions implemented early in the 2009 water year in response to a 10% CVP allocation which was later increased to 40%, creating a source of surplus water. Crop shifting actions did not include rice fields. The transfer water will be pumped at the State Water Project's Banks Pumping Plant utilizing its excess capacity. Transferred water will be delivered to SLDMWA member agencies participating in the SLDMWA 2009 Pooled Water Transfer Program to benefit agricultural water users within their respective service areas, in order to provide a small incremental water supply to supplement their allocations under south of Delta CVP water service contracts, currently at 10%.

Reasons for Exemption
The Project is subject to the Governor's Proclamation of a State of Emergency of February 2, 2009, among whose purposes is to continue to implement water management practices in order to minimize economic impacts to agriculture and make the best use of available water supplies (section 20). Section 17 of said Proclamation directs the CEQA exemptions under these section as well as CCR title 14, section 15269(c) shall apply. The Secretary for the California Natural Resources Agency and the Secretary for the California Environmental Protection Agency have concurred that using the above CEQA exemptions for the this Project is consistent with the Proclamation.
