Document Description
The Project approved by the CDFW consist of the ITP and MSAA identified above, which address construction and operation of the Merced to Fresno segment of the California High-Speed Train (HST), as approved by the lead agency, affecting or generally related to fish and wildlife resources subject to the regulatory authority of CDFW, including natural resources subject to the California Endangered Species Act (CESA) and Fish and Game Code Section 1600 et. seq. For purposes of CESA, the ITP authorizes incidental take of California tiger salamander (Ambystoma californiense), Swainson's hawk (Buteo swainsoni), and San Joaquin kit fox (Vulpes macrotis mutica) (collectively, the Covered Species), all in connection with otherwise lawful activities within the Project area. The MSAA authorizes certain activities contemplated in Section 1602 of the Fish and Game Code that could cause substantial adverse effects to fish and wildlife resources. The ITP and MSAA in this respect will facilitate construction and operation of the Project.
