Approval of a Removal Action Workplan by the Department of Toxic Substances Control pursuant to Health & Safety Code, chapter 6.8 as submitted on March 11, 2009 by DeNova Homes. The proposed removal action is Enhanced Bioremediation with Monitored Natural Attenuation for the groundwater at the Site. A former solvent washing operations impacted the Site's groundwater to approximately 500' laterally from the source area. Groundwater was encountered at approximately 50' below ground surface beneath the Site during the Site investigations. Based on the human health screening, the Site soil meets unrestricted land use standards. However, the risk calculations indicated consumption and exposures to groundwater would pose a significant threat to human health. Based on this evaluation, DTSC required remediation of the groundwater.

Reasons for Exemption
The project is exempt for the following reasons:
1) The project is a cleanup action to be taken to prevent, minimize, stabilize, mitigate or eliminate the release or threat of release of a hazardous waste or substance.
2) The project is a remoavl action costing $2 million or less.
3) The project will not be located on a site which is included on any list compiled pursuant to Cal. Gov. Code Section 65962.5.
4) The project will not have a significant effect on the environment due to unusual circumstances.
5) The project will not result in damage to scenic resources, including but not limited to, trees, historic buildings, rock outcroppings, or similar resources, within a highway officially designated as a state scenic highway.
6) The project will not cause a substantial adverse change in the significance of a historical resource.
7) The project will not require onsite use of a hazardous waste inciderator or thermal treatment unit.
8) The project will not require the relocation of residences or businesses.
9) The project will not involve the potential release into the air of volatile organic compounds as defined in Health & Safety Code Section 25123.6.
10) The cumulative impact of successive projects of the same type on the same place, over time, if there are any, will not be significant.
11) The project will be consistent with applicable State and local environmental requirements including, but not limited to: (a) excavation and offsite disposal; (b) air quality rules such as those governing particulate matter; and (c) approved by the regulatory body with jurisdiction over the site.
