Document Description
DWP, on behalf of Reclaimation District No. 756 and Delta Reclamation District No. 2026, proposes to transfer up to a total of 17,941 acre-feet of water to MWDSC during 2009 due to the current statewide drought and the need for additional water by MWDSC to meet its municipal needs. DWP proposes to fallow land on Bouldin Island and Webb Tract and transfer this water to MWDSC. Water will be made available at banks Pumping Plan and be conveyed to MWDSC using SWP facilities.

Reasons for Exemption
a. SWP long-term water supply contract includes provisions for delivery of water within the SWP place of use.
b. No construction is required to implement the proposed exchange. The conveyance will involve existing facilities already in use. The water will be used within MWDSC to meet the needs of existing customers who are facing water use reductions caused by the third year of a drought and by SWP being able to deliver only 40% of water requested this year.
c. The facilities owned and/or operated by DWR and MWDSC are existing facilities that have not been expanded or modified to implement the proposed changes.
d. This temporary water transfer is a response to the critical water shortage conditions caused by the third year of continuing drought conditions in California. These conditions, the resulting adverse economic effects, and the critical needs of the public for additional water are the same as the reasons cited in the Governor's drought emergency proclamation of February 27, 2009. DWR's conveyance of this water is in part an action responding to the Governor's Proclamation.
