Document Description
The 2009 Drought Water Bank Program is a one-year transfer program to obtain water from willing sellers upstream of the Delta for sale to water users experiencing shortages due to extreme drought conditions and regulatory pumping curtailments. The San Luis Water District proposes to acquire Drought Water Bank supplies via an argument with the San Luis and Delta Mendota Water Authority which for the benefit of its member agencies has entered into an agreement with Department of Water Resources for the purchase of Drought Water Bank supplies.

Reasons for Exemption
Continued: and Section 21772 The project is subject to the Governor's Proclamation of a State of Emergency noticed February 2, 2009 (attached), among whose purposes is to continue to implement water management practices in order to minimize economic impacts to agriculture and make the best use of available water supplies (section 20). Section 17 of a said Proclamation directs that CEQA exemptions under these sections as well as CCR title 14, section 15269(c) shall apply. The Department of Water Resources is the Lead Agency for CEQA purposes. As a Responsible Agency, the San Luis Water District has determined that its participation in the 2009 Drought Water Bank falls within these exemptions.
