Reasons for Exemption
The City of Benicia finds that the subject activity is exempt from CEQA, as specified in Guidelines Article 19 - Categorical Exemptions, Section 15308 - Actions by Regulatory Agencies for the Protection of the Environment. Specifically, the removal of unauthorized bay fill in the form of abandoned vessels and accompanying marine debris is: (a) required by State ordinance to restore and protect the environment; and (2) will be conducted using Best Management Practices for protection of the environment, including surface boom and silt/turbidity fencing measures.
