After reviewing the project and its setting, the environmental Coordinator for the County of Tuolumne has determined that the project is categorically exempt from review under the California Environmental Quality Act (CEQA), pursuant to Section 15269(C) of the State CEQA Guidelines because specific actions necessary to prevent or mitigate an emergency are statutorily exempt from review under the California Environmental Quality Act (CEQA). The project entails the adoption of an ordinance that would enact new definitions and regulations to continue to prevent damage to land and improvements. As such, the adoption of the proposed ordinance constitutes an action taken by the legislative body of Tuolumne County to reduce the potential for substantial property damage by floodwater; consequently, the proposed project is not subject to environmental review under CEQA pursuant to Section 15269 (C) of the State CEQA Guidelines.
