Document Description
The purpose of this Ordinance is to establish an appropriate method of enforcement for violations is an administrative citation program as authorized by Government Code Section 53069.4. The procedures established in this Ordinance shall be in addition to criminal, civil, or any other legal equitable remedy established by law which may be pursued to address violations of Authority ordinances. The Authority Board has found and determined that the enforcement of Authority ordinances is a matter of local concern and serves as important public purpose. Pursuant to Government Code section 53069.4, the authority has adopted this administrative citation program in order to achieve the following goals:
(1) To protect the public health, safety and welfare of the residents of Del Norte county;
(2) To gain compliance with Authority ordinances and regulations adopted pursuant thereto in a timely and efficient manner;
(3) To provide for an administrative process to appeal the imposition of administrative citations and fines;
(4) To provide a method to hold parties responsible when they fail to refuse to comply with the provisions of an Authority ordinance;
(5) To minimize the expense and delay where the alternative remedies are to pursue responsible parties in the costly and time-consuming civil or criminal justice system.
(6) Use of this chapter for the enforcement of Authority ordinances shall be at the sole discretion of the Authority, and its officers, agents and employees.

In addition to the Categorical Exemptions described above, the Authority Board of Commissioners has found, pursuant to CEQA Guidelines section 15061(b)(3), that "it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment." in addition, the Ordinance is subject to a Class 1 categorical exemption pursuant to CEQA Guidelines § 15301 in that the activities mandated by the ordinance will occur at existing residential and commercial establishments and, therefore, consist "...of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination...The key consideration is whether the project involves negligible or no expansion of an existing use."
