Document Description
The purpose of this Ordinance is to protect the health, safety, and welfare of the residents of Del Norte County and the City of Crescent City through the prevention and abatement of public nuisances associated with the mismanagement of discards, the blight associated with inappropriately accumulated materials, improperly stored discards, items, products, and packaging which are hazardous, and illegal disposal. It shall be liberally construed to that end.

In addition to the Categorical Exemptions described above, the Authority Board of Commissioners has found, pursuant to CEQA Guidelines section 15061(b)(3), that "it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment." in addition, the Ordinance is subject to a Class 1 categorical exemption pursuant to CEQA Guidelines § 15301 in that the activities mandated by the ordinance will occur at existing residential and commercial establishments and, therefore, consist "...of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination...The key consideration is whether the project involves negligible or no expansion of an existing use."
